BARGAINING COMPLETED
NEW FINAL OFFER FOR RATIFICATION
The CANZ Negotiation Team has
completed talks with the Department of Corrections for the renegotiation of the
CANZ / PS Collective Agreement and a summary of the offer, and other important
matters in relation to the offer are set out below.
The CANZ National Executive will
teleconference as soon as is possible to discuss the offer and to make a
recommendation to either accept or reject the offer prior to a full round of
meetings.
CANZ will be giving the Department
notice of a full round of meetings, and a schedule of those meeting dates and
times will be made available to CANZ members in due course.
THE
SALARIES AND THE TERM
The offer is for a 2 year term
beginning 1 January 2008 and expiring on 31 December 2009, with a commitment to
start negotiations 4 months before it expires (August 2009).

A 3% increase for the first 12 month
term, and a 3% increase in the second 12 month term.
If the offer is ratified the
salaries will be backdated to 1 January 2008.
Note:
All annual salaries are to be converted to the P Calc pay system which affects
Corrections officers only and effectively means for Corrections Officers the
increase is the equivalent of 3.3% and 6.4% to their existing
A one off lump some payment of
$750.00(gross) for all full time employees covered by the Collective Agreement
(pro rata for part time). Provided that CANZ advises the Department in writing
by 30 June 2008 that it has ratified the Collective Agreement.
The Department has indicated that
beyond 30 June 2008 the funding for the retrospective provisions (backdating),
will disappear and will no longer be available to the Department.
Work Practices
Project
As per the previous offer, it is
agreed to jointly scope a Prison Serviced Operational Project to deliver
flexibility and improved service delivery in Prison Services and potentially
improvements to terms and conditions of employment.
Public
Holidays
Shift workers will
receive a lieu day for all Public Holidays except Waitangi and Anzac Day, as
follows (to become a new clause 6 under Public and Development Holidays):
“For a full time shift/rostered
worker, if a public holiday is observed on an off duty day, they shall be
granted a day in lieu, except in the case where the off duty day is either
Anzac Day or Waitangi Day. Such days in
lieu are not Alternative Holidays under the Act; however they shall be taken in
accordance with the provisions of the following clause.
NB:
Shift and Rostered workers are defined as most Corrections Officers and Nurses.
This clause effectively means an extra 3 to 5 days paid leave per annum.
PS
agrees to deem this provision operative from 1 January 2008.
Nurses
Add:
“PS will pay professional Fees for Nurses”. Note: presently these fees are
$96.00 per year.
Administration Workers
Increase
salaries by 3% in year 1. Salaries will increase by no less than 3% in year 2.
Subject to funding, these increases may be exceeded as a result of the one off
and translation exercise to be worked through during 2008.
RPL.
As per
the previous offer, PS are offering the opportunity to participate in the
recently completed Recognised Prior Learning process for employees who
were already in PS prior to 1 July 2006 with the associated salary recognition
backdated to be effective from 1 January 2008.
Staff
will have one month after completion of the
HDA
PS agrees
to reduce the qualifying period for HDA for SCO and PCO from 5 days plus 1 to qualifying
for HDA after 5 days.
ACRP / Mt
It
is agreed that PS and CANZ will discuss outside of the Bargaining, cross site
cooperation and the amalgamation of the PS and ACRP Collective Agreements as
the redevelopment of the ACRP / Mt Eden site is progressed.
This
is a very important matter for all Corrections Officers and will be discussed
at the upcoming meetings.
There
is also the potential to take account of any outcomes from the Work Practices
Project.

Long Service Leave
The
Department will allow employees who reach 18 years service to anticipate one week’s
long service leave, prior to the 20 year qualifying period.
Recognition
of the value of collectivism
Add: “Union members who
have completed 10 years service are eligible, once only, for unpaid sabbatical leave
of up to 12 months. Requests for such
leave must be made three months before the proposed start date of the
leave. Such employees shall have
preference for re-employment which will exist for three months from the date
the intention to return to work is notified in writing to Prison Services. Written advice must also be given to the
recruiting manager that the entitlement is being exercised at the time when the
application for a position is made”.
Technical Issues
All references to Public
Prisons Service or PPS will be altered to become “Prison Services” or “PS”.
To comply with the
Holidays Act, a provision will be added to confirm that employees will normally
receive their holiday pay for annual leave in accordance with the usual pay
cycle, but may request that their holiday pay be paid before they commence annual
leave of one week or more and provided Payroll have no less than two weeks
notice of this in time to do so.
